Every stage of litigation produces its own opportunity for settlement discussions, and each stage contains its own procedural and time requirements. The vast majority of cases settle before trial. Outside of the IP and class action context, we estimate the time required for each stage as follows: complaint and initial dispositive motions (3-7 months), discovery (anywhere from several months to a year or more depending on the complexity and size of the litigation), summary judgment (3-5 months), trial (typically days to a few weeks), and first appeals (6-10 months).
